Terms of Service
These Terms of Service ("Terms") govern your access to and use of the Adyours website and platform (the "Service"), operated by Adyours ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
Adyours is an advertising management platform that lets you connect your Amazon Advertising and Meta (Facebook and Instagram) advertising accounts to build, launch, manage, and report on ad campaigns from a single dashboard. The Service is currently offered in beta and may change as we develop it.
2. Eligibility & accounts
You must be able to form a binding contract and use the Service for a lawful business purpose. You are responsible for keeping your login credentials secure and for all activity under your account. Notify us promptly of any unauthorized use.
3. Connecting third-party accounts
The Service works by connecting to Amazon and Meta through their official authorization. You authorize us to access and act on your connected accounts to provide the features you use. Your use of Amazon and Meta remains subject to their own terms and policies, and you are responsible for complying with them. You can disconnect a platform at any time.
4. Your responsibilities
- You are responsible for the campaigns, budgets, creatives, and content you create or publish through the Service.
- You will not use the Service to violate any law or the terms of Amazon, Meta, or any other connected platform.
- You are responsible for all advertising spend, which is paid by you directly to the advertising platforms — Adyours does not collect or hold your ad budget.
5. Fees
Paid plans are billed as described on our Pricing page. During beta, the Starter plan is free. We will notify you before any charge begins. Fees are exclusive of applicable taxes. Custom (Scale) pricing is agreed separately.
6. Acceptable use
You will not misuse the Service, including by attempting to access it in an unauthorized way, interfering with its operation, reverse-engineering it, or using it to send unlawful, deceptive, or infringing content.
7. Intellectual property
The Service, including its software, design, and content (excluding your data and the platform data you connect), is owned by Adyours and protected by law. We grant you a limited, non-exclusive, non-transferable right to use the Service during your subscription. You retain all rights to your own data.
8. No guarantee of results
Advertising outcomes depend on many factors outside our control. Adyours provides tools and recommendations but does not guarantee any particular sales, revenue, ranking, or advertising performance.
9. Availability
We work to keep the Service available and reliable, but it is provided on an "as is" and "as available" basis during beta. We may modify, suspend, or discontinue features with reasonable notice where practical.
10. Limitation of liability
To the maximum extent permitted by law, Adyours will not be liable for any indirect, incidental, special, or consequential damages, or for lost profits, revenue, or data, arising from your use of the Service. Our total liability for any claim will not exceed the fees you paid to us in the three months before the claim.
11. Termination
You may stop using the Service and close your account at any time. We may suspend or terminate access if you breach these Terms or use the Service unlawfully. On termination, your right to use the Service ends; data handling follows our Privacy Policy.
12. Changes to these Terms
We may update these Terms from time to time. Material changes will be reflected by the "Last updated" date, and continued use after changes means you accept them.
13. Governing law
These Terms are governed by the laws of India, and the courts of India will have jurisdiction over any dispute, without regard to conflict-of-law rules.
